EU demands Britain gives more rights to migrants: Commissioner wants citizens to 'enjoy same rights they have at home in other member states'

Viviane Reding is pressing for a 'common area of justice'
It could bring onerous new rules and obligations to the UK
Commissioner also wants EU to establish its own version of MI5

Eurocrats will today demand that Britain give 'rights without borders' to EU migrants.

In a move certain to spark a new row with Westminster, EU Commissioner Viviane Reding is pressing for a 'fully functioning common area of justice'.

Most controversially, citizens would be able to 'enjoy the same rights they have at home in another Member State' - potentially importing a string of onerous new rules and obligations to the UK.

In a pointed reference to Britain, Ms Reding said new rules were vital at a time when 'the right to free movement of EU citizens is being challenged by some'.

The Government is currently facing a string of legal battles with Brussels over attempts by the Prime Minister to restrict some of the benefits paid to migrants.

Ms Reding's blueprint will be presented to a meeting of the EU Justice Council in Brussels, attended by Chris Grayling, today.



The commissioner - who also wants the EU to establish its own version of MI5 - is seeking a formal agreement by the end of the week.

Migrants would be expected to enjoy uniform rights, such as those laid down by the European Union's controversial Charter of Fundamental Right ,which includes the right to strike and collective bargaining.

Documents drawn up by Ms Reding, who is from Luxembourg, says there are currently 14million EU citizens residing in a Member State of which they are not a national - including around 2.3million in the UK.


She says: 'Despite progress in the enjoyment of their EU rights, obstacles remain.

'Citizens still experience practical and legal difficulties when they to enjoy the same rights they have at home in another Member State.

'The EU needs to address these obstacles with determination, while continuing to enable the fight against abuse, particularly at a time when the right to free movement of EU citizens is being challenged by some.'

The papers, which have been circulated to justice ministers across the EU, continue: 'EU justice policy should continue to be a driver for economic recovery, growth and tackling unemployment.

'Structural reforms need to be pursued so as to ensure justice systems are capable of delivering swift, reliable and trustworthy justice thereby supporting the effectiveness of other policies.

'On this basis, the goal of the next generation of EU justice policy should be to bring about a fully functioning common area of justice by 2020 in which justice and citizens' rights will know no borders anymore.'

The plans will be resisted by Justice Secretary Mr Grayling, who has clashed regularly with Ms Reding.

Last night, a Whitehall source said: 'Heaven knows why we keep seeing proposals like this appearing. This may be Commissioner Reding's vision for the future, but there's no appetite in this country for our justice system to be 'Europeanised'. This is just more mission creep out of Brussels.'

Ms Reding also wishes set-up a dedicated intelligence agency to rival MI5, MI6 and GCHQ. She says the new spy agency is needed to keep track on the surveillance activities of GCHQ.

The UK taxpayer would be expected to pick up a huge bill for funding the new agents.

It follows claims that GCHQ, in partnership with America's National Security Agency, has been carrying out mass surveillance on EU citizens, diplomats and heads of State.

The eurocrats were furious after the fugitive Edward Snowden stole documents from the NSA apparently showing how major EU powers, including German Chancellor Angela Merkel, had been snooped upon.

I think the government should do this straight away and when these so called migrants apply for cash or help of any kind pay them what they would have got in their own countries, excellent idea do it now before they change their mind
